  • Payment Processor – Stripe Payments UK Ltd and its group companies (“Stripe”), and GoCardless Ltd (“GoCardless”), the third parties we use to process card and Direct Debit payments respectively on our behalf.

  • the singular includes the plural and vice versa;
  • references to sub-clauses, clauses, schedules or appendices are to sub-clauses, clauses, schedules or appendices of this privacy policy;

  • reference to any statutory provision includes any modification or amendment of it;

Scope of this privacy policy

This privacy policy applies to the actions of Marches HR Ltd in relation to the Website, and more broadly to any Data we collect and process about clients, prospective clients and other individuals in the course of providing our services (including where that Data is collected by telephone, in meetings, in person, or on paper and not only where it is collected through the Website). It does not extend to any websites that can be accessed from this Website including, but not limited to, any links we may provide to social media websites.

For purposes of the applicable Data Protection Laws, Marches HR Ltd is the “data controller” in the context of this privacy policy. This means that Marches HR Ltd determines the purposes for which, and the manner in which, your Data is processed.

Data collected

We may collect the following Data, which includes personal Data, from you:

  • name;
  • job title;
  • profession; and
  • contact information such as email addresses and telephone numbers;
  • billing and transaction information where you purchase a service through our online checkout, such as the amount paid, the service purchased and your billing name and address (see ‘Payment processing’ below – we do not collect or store your full card details ourselves);
  • audio recordings, and any personal Data disclosed within them, where a telephone call or meeting with us is recorded (see ‘Call and meeting recording’ below);

Data that is given to us by you

Marches HR Ltd will collect your Data in a number of ways, for example:

When you register with us and set up an account to receive our services, the legal basis for this processing is the performance of a contract between you and us and/or taking steps, at your request, to enter into such a contract.

Payment processing

Where you purchase a service through our online checkout, your payment is processed by Stripe, our third-party Payment Processor. We do not collect, see, or store your full card number, expiry date or CVC – these are entered directly into Stripe’s secure payment form and handled under Stripe’s own privacy policy, available at https://stripe.com/gb/privacy.

We receive confirmation that payment has been made, along with limited transaction details (such as the amount, date, service purchased and billing name/address) which we use for invoicing and our own accounting records. The legal basis for this processing is performance of a contract with you and compliance with our legal obligations (for example, tax and accounting requirements).

Where you choose to pay by Direct Debit rather than by card, your payment is collected via GoCardless Ltd, our third party Payment Processor for Direct Debit. We do not collect or store your full bank account details – your sort code and account number are entered directly into GoCardless’s secure mandate form and handled under GoCardless’s own privacy policy, available at https://gocardless.com/legal/privacy/. We receive confirmation that a mandate has been set up and that payments have been collected, along with limited transaction details, which we use for invoicing and our own accounting records. The legal basis for this processing is performance of a contract with you and compliance with our legal obligations.

Call and meeting recording

We may record some telephone calls and meetings with clients (or their employees / workers) and prospective clients, for the purposes of:

  • keeping an accurate record of what was discussed and agreed, particularly in relation to HR advisory and workplace investigation matters;
  • training and quality assurance; and
  • resolving any dispute about the content of a conversation, where necessary.

Where a meeting is going to be recorded, we will let you know verbally at the time. Where necessary (for example, for investigation meetings) we will also tell you in advance that the meeting will be recorded and give you the opportunity to object. If you would prefer not to be recorded, you can let us know and we will make a written note instead.

The legal basis for recording is our legitimate interest in maintaining an accurate record of client conversations, particularly given the sensitive and sometimes contested nature of workplace investigation and HR advisory work. Where a recording captures special category data (for example, health information disclosed during a call), we rely on the additional condition of Article 9 GDPR that processing is necessary for reasons of substantial public interest / establishment of legal claims, as applicable to the circumstances.

Recordings are stored securely and access is limited to those who need it to deliver or supervise the relevant service. We retain recordings as follows:

  • investigation meeting recordings – until a signed transcript of the meeting has been produced, after which the recording is deleted;
  • non-investigation meeting recordings – until summary notes of the meeting have been captured on our CRM system, after which the recording is deleted;
  • call recordings – stored on our CRM system for the duration of our contract with the relevant client, plus 7 years.

Who we share Data with

We may share your Data with the following groups of people for the following reasons:

  • our employees, agents and/or professional advisors, for marketing purposes;
  • third party service providers who provide services to us which require the processing of personal data, where applicable;
  • Stripe and GoCardless, our third-party Payment Processors, who process card and Direct Debit payments respectively on our behalf;
  • relevant authorities, where applicable;

in each case, in accordance with this privacy policy.

International transfers of Data

Some of the third parties we use, including Stripe and GoCardless, may store or process Data outside the UK, including in the United States. Where this happens, those third parties are required under their own standard terms to apply appropriate safeguards, such as the UK International Data Transfer Addendum to the EU Standard Contractual Clauses, or to participate in a recognised adequacy or certification framework. Keeping Data secure

We will use technical and organisational measures to safeguard your Data, for example:

  • access to your account is controlled by a password and a username that is unique to you.
  • we store your Data on secure servers.

Data retention

Call and meeting recordings are retained in line with the periods set out in ‘Call and meeting recording’ above.

General
